The case of the contract of the Christian Investigation and Security Agency (CISA) to secure the Davao del Norte Capitol is turning now to be quite an interesting case for the court to decide. Naa man goy contentious legal question nga dili maresolbar sa sulod kay puros may mga puntos ang duruha ka managbanging partido, ug maresolbar lamang kini sa mga hanas sa balaod. Aw, inato, praktikalan man lang ni ang ato. Kinsa man diay ang mohukom? Di ang atong korte.

Our editorial tells the contentious issues and circumstances surrounding the bidding and awarding of the security services contract won by CISA. Tataw nga gi-bypass gyod si Vice Gov. Victorio “Baby” Suaybaguio Jr, kinsa maoy acting governor gikan sa Dec. 20, 2010 hangtod Enero 8, 2001 sa pag-abot ni Gov. RDR sa probinsya gikan sa Estados Unidos.

Vice Gov. Suaybaguio was evidently bypassed by the Capitol triumvirate composed of provincial administrator Rufo Peligro, provincial Bids and Awards Committee (BAC) chairman and provincial general services officer Samson Sanchez and provincial legal officer Atty. Jennifer Namoc. A rose between two thorns. If they have no respect to the person occupying the post of the acting governor, they should have respected (and they ought to respect) that post occupied by Vice Gov. Suaybaguio.

There is a need to settle the legal question in court. But who can file a case against the governor and the Capitol triumvirate? Sa Davao del Norte, kinsay mamahimong Boardmember Quisumbing ug tulo niya ka kaubanan sa SP sa Cebu kinsa mikaso kang Cebu Gov. Gwendolyn Garcia kabahin sa panginahanglan sa prior authorization o approval sa SP usa mokontrata ang gobernador bisag naaprobahan na ang annual budget diin anaa nahisulod ang galastuhan sa maong kontrata?

The bidding where CISA won was Dec. 20, 2010. Taking PA Rufo Peligro’s assertion that there was no need for an SP’s prior authorization for the sake of argument, matud pa mismo sa balaod, Akta Republika 9184, gikinahanglan japon nga mo-issue ang naglingkod nga gobernador ug Notice to Proceed sulod sa 7 ka adlaw human madeklarar ang winner sa bidding. Suaybaguio japon ang acting gov kinsa may tanang gahom sa governor gawas lang sa gahom sa pag-hire ug pag-fire ug mga empleyado. Morag mao kining parteha ang Achilles’ heel o patyanan sa maong transaksyon kung makalusot man nga di na kinahanglan ang prior SP authorization.

There is no debate now as to the noble purposes and objectives the privatization of security services in the Mankilam Capitol. These are all valid. But in good governance, procedures must still be followed. This is an interesting case that must be settled in court at the earliest time while the CISA guards have not yet eaten a budget of the approved annual budget, or as in Cebu case, the COA declared so that Gov. Garcia’s transaction was illegal as it needed prior SP authorization. Nah, basig ma-disallow pa ang makuhang kwarta sa CISA gikan sa Kapitolyo ug makatapada ug dako and Capitol triumvirate apil na si Gov. RDR. We are awaiting if this case is within the legal penumbra of the 2008 Supreme Court ruling on Cebu Boardmembers Gabriel Garcia et al versus Gov. Garcia (GR 175527). Nahisulod ba kini bisag sa kilo-kilom nga bahin diha sa buhagay sa sulaw sa bilog nga buwan kalabot sa maong desisyon sa Korte Suprema?

The gun ban started last Sunday and in Davao del Norte and Compostela Valley provinces a few police and military elements and private persons were arrested. It’s a good sign that our police force made arrests at the start, since we know that armed bodyguards of politicians abound in our provinces. We hope the PNP conducts a no-nonsense and no-sacred-cow campaign for the gun ban until victors are declared in the May elections. For one, we know of a congressman having armed bodyguards in tow. What to do with them now? Are they exempted from the gun ban?

Tagum City PNP chief Giusseppe Geralde bared that not even with those in the intelligence community including police and military assets who are armed in public places and not in operations are exempted from the gun ban. They face apprehension by Geralde’s uniformed policemen. This is to prepare and ensure peaceful May elections.

PSupt. Geralde has an early assessment that for Davao del Norte and Tagum City he expects peaceful elections to come considering the lack of rivals of incumbents, and knowing that Mayor Rey Uy is a “strong candidate”. Besides, Governor Rodolfo del Rosario has no opponent, he said. We have long known also that Uy’s rivals- former Governor Yayong Gementiza and Congresman Arrel Olano aren’t warlord type politicians who have a bunch of armed bodyguards in company.

It was Vice Governor Victorio “Baby” Suaybaguio Jr who said to me that Davao del Norte’s politics is by nature good. It’s where you see rival politicians reconciling and becoming friends again. He cited ex-Gov. Yayong, who opposed Gov. Del Rosario in gubernatorial fight in 2007 polls, being seen later shaking hands with the governor during last year’s State of the Province Address. It’s good that in this side of the country, politicians fought tooth-and-nail, with doses of black propaganda during the campaign period, and later before the next polls they reconciled. Vice Gov. Baby once fought City Mayor CO in a hotly contested mayoral bout in 2004, and now they belong to the same opposition party- the Liberal Party of Noynoy-Mar tandem. Baby lost in that political battle. He is confident of Mayor CO ’s backing of him in his current reelection bid for vice governor.

BLOGS AND BITS: Rival politicians in Davao del Norte were seen elbowing each other during the opening of a new FM station in Tagum City- the 100.7 Perfect Seven Radio Caritas. Seen were Gov. RDR, ex-Gov. Yayong, Vice Gov. Baby, BM Israel, ex-Kons Boyet Gementiza, who’s running again for councilor. Cong. Olano and Mayor CO , who were both invited, were not there. It was almost a party…. NTC regional director Josue Go was also there. With regards to local FM stations “usurping airwaves” of Davao City FM stations, he said he has yet to receive complaints from the public. Either the local FM signal is too strong, or the signal of Davao City FM stations is weak, Go offered an initial explanation. But NTC should investigate on this with or without a complaint. Youths going loco over new musical hits have been complaining of hearing only one FM station in their locality after its operation which shut down reception of other FM stations especially those from Davao City which offer variety of music genres to choose from…. Heard in the rounds that the Daneco board is “infected of aliens”. Buzzwords said that some Daneco BOD members allegedly want to make the cooperative come crushing down to smithereens for the private sector to come in. Deja vu Aboitiz privatization buy-out scheme? NEWS: “Baby will defeat AGR”- Yayong

Former Davao del Norte Governor Gelacio “Yayong” Gementiza in an interview yesterday made his early electoral prediction that Vice Governor Victorio “Baby” Suaybaguio Jr will defeat the governor’s son Anthony Rafael del Rosario (AGR) once the two would decide to slug it out for the District 2 congressional post in 2010 polls.

Speaking in his sprawling residence cum copra warehouse in Apokon, Tagum City, Gementiza said that AGR, who was reported last week to have recovered from his Stage 3- Hodgkin Lymphoma cancer following chemotherapy treatments, could not win over Suaybaguio saying that “ay sus Tagum lang ang tan-awon (they could only glance it in Tagum) “given that Suaybaguio had served for 9 years as a mayor here”. “Modaug lagi si Baby!”

The former governor reiterated his earlier political remark that AGR is closely identified to have hailed from District 2 and not from District 1 despite than he has already established a residence in the city.

“But Baby is more popular than (Cong. Arrel) Olano, who defeated twice (Pantaleon) Bebot Alvarez due to the issue of non-residency,” Gementiza added.

Based on this result, he said that the people of Tagum will always ask, nasapawan man ta (somebody rises from outside of  them) and would not want it.

Gementiza also opined that if he were the father of a son politician who has recovered from cancer he would not allow him to be drafted to go through the rigors of electoral campaigns especially in a congressional race where it is a must that the candidate should really sweat it out to individually campaign to each and everyone.

“And how much more if you win. Trabaho gyud ang naa sa Congress (it’s all work in Congress),” he added.

Gementiza said that based on what his friend physicians have told him there is a “need for a five-year rest” to those who have survived from cancer.

He further said that given this AGR could have an option of running for governor if his father Gov. Rodolfo del Rosario (RDR) would opt to retire and “in this case RDR would take charge of the campaigning”.

Obviously giving unsolicited advice, he added: “And if AGR wins as governor he can still run the Capitol through his administrator and the vice governor.”

In the same interview, Gementiza also confirmed that he had already applied to RDR for him to go back to the Lakas fold, which has yet no action taken by the Lakas party in the province at press time. “Pero daghan ang mobabag ana (Many will block my application)”.

Asked on what post he would aspire by 2010, he shot back: “ayaw sa, wala sa (none yet)”.

In 2007 Gementiza made a jump ship from Lakas close before elections and subsequently ran but failed in his gubernatorial bid for reelection against the comebacking RDR. (Cha Monforte/Rural Urban News)
