In prohibiting vans in Panabo City
Following discontinuance of passengers’ vans to drop in his own Panabo City terminal, City Mayor Jose “Joe” Silvosa Sr. said in an interview that van operators have no other alternative but go to the court and “file a legal case to define the law”.
“Let the court interpret, and they can petition a Regional Trial Court for declaratory relief with no less than the LTFRB as the respondent,” he said commenting on Land Transportation and Franchising Regulatory Board Memorandum Circular No. 2007-007 which prohibits passengers’ vans from soliciting and unloading passengers along the route from the two authorized points or two terminals under the garage-to-terminal (GTE), point-to-point (P2P) express franchise.
He said that the case would most possibly go up to the Supreme Court, which would finally define the law.
Last November 13 Panabo City followed suit in the traffic stance of Tagum City. The latter has not allowed passengers’ vans to drop in its own terminal eversince they emerged in the street.
Tagum City has been most strict in implementing the LTFRB circular for a month now following row between Mayor Rey Uy and the National Bureau of Investigation.
But in upholding the law, Panabo City government is losing more than a million from the terminal fees it had then collected from the dropping of vans.
City market chief Nemesio Rasgo bared that at the average they collected “P2,500 daily or about P1.5 million in each year”.
But Mayor Silvosa said that the decision was of the market committee after duly calling the attention of van operators.
He said the market committee’s move followed after receipt of petition letter from owners of passengers’ buses.
The Panabo City’s terminal fee is P12 per drop of van.
Meanwhile, sources said that the terminal fee of Monkayo is P25 while Montevista, Nabunturan, Mawab and Carmen have P15 for each dropping van.
At the average of 200 terminal-dropping vans for the six public terminals in the route, the terminal fees would total at least P17,000 daily or P500,000 monthly or P6 million yearly, or at least P3,000 daily for the P15-charging terminal.
But the number of plying vans now has noticeably declined. (Rural Urban News/Cha Monforte)
