NEWS: P1,500 fine for not wearing standard helmets to effect

Forget and throw away your cheap, breakable and giveaway crash helmets in the coming days as chances are you’ll be apprehended and fined of P1,500 for not wearing the one prescribed by the Land Transportation Office.

On the heels of the report that the Land Transportation Office will be implementing full blast so soon an administrative order (EO) on new rules and regulations for single motorcycles, Tagum City Councilor Joedel Caasi has slammed the LTO for not consulting local government units before coming out an EO that he said metes out exorbitant fines to traffic violators among single motorcycle drivers.

He also castigated LTO personnel form Davao City who jumped to Tagum City at anytime and right away effect apprehension to motorcycle drivers violating the LTO’s new regulations on single motorcycles.

He said that under the new order the helmet prescribed is a hard top with styrofoam cushion inside it.

Under the Dept. Of Transportation and Communication-LTO AO No. AHS-2008-015 on rules for the use and operation of motorcycles on highways, the “standard helmet” is defined as a protective helmet approved by the Dept. of Trade and Industry (DTI) with PNS-UNECE 22 marking, a presumably hard and tested type that could protect the head on strong impact.

Failure of the driver and/or the passenger or back rider to wear it carries a fine of P1,500 as against the present P150 fine under the city’s helmet ordinance.

AO No. AHS-2008-015 was issued by the DOTC last May 15 pursuant to Executive Order 292 which mandates the LTO to enforce.

Aside from the existing traffic and motorcycle rules, the latest AO has a one backrider and no-cargo policy. Allowed is only the saddle bag or luggage carrier, which is defined as a DTI- approved built-in carrier of luggage in a motorcycle. Both carry a fine of P1,000.

Drivers must also not wear flip flops, sandals or slippers or drive bare-footed or be fined of P500, P700 and P1,000 and revocation of driver’s license for the first, second and third offenses, respectively.

For having defective accessories such as headlight, tail light, signal light, brake light, side mirror and horn has a fine of P1,000.00.

For modifying any part of the original designs of a motorcycle or scooter without approval of the LTO and the DTI has a fine of P2,000.00.

Caasi said that many of the AO provisions are not proper and could dampen the single motorcycles as the cheapest mode of transportation the city has yet, saying that he observed of many of these being used by families to ferry their children to and from the school.
